Hervé Le Lay es socio de MCL Arbitration. Está admitido en el Colegio de Abogados de París y su práctica se centra en disputas internacionales.
Hervé es un abogado experimentado en disputas comerciales. Ha intervenido en numerosos arbitrajes institucionales (CCI, SCC, LMAA, LCIA, OMC, etc.) y ad hoc (incluida la CNUDMI), así como en procesos judiciales ante tribunales civiles y comerciales franceses, incluyendo procedimientos de peritaje judicial, así como de ejecución y apelación contra laudos o sentencias arbitrales extranjeras. Con frecuencia interviene en la etapa pre contenciosa, incluso en el contexto de procedimientos de mediación y conciliación.
Hervé ha adquirido experiencia significativa en disputas sobre una extensa variedad de sectores y operaciones (construcción, post-M&A, disputas de accionistas y joint ventures, medios de comunicación, energía, ventas internacionales, responsabilidad por productos defectuosos y riesgos industriales, contratos de agentes, seguros y reaseguros, proyectos mineros, infraestructura, etc.), sujetas a una amplia variedad de leyes aplicables y sedes de arbitraje.
Hervé actúa regularmente como árbitro y es, en particular, miembro de las listas de árbitros del Comité Francés de la CCI, KCAB International, AIAC, BVI IAC y del TAS.
Hervé también es parte de la lista de árbitros del Tribunal Arbitral del Deporte y tiene vasta experiencia en la resolución de controversias ligadas al deporte. Ha participado en numerosos procedimientos relativos a cuestiones comerciales (transferencias, fusiones y adquisiciones, derechos de televisión, sponsoring, etc.) y cuestiones reglamentarias/disciplinarias (dopaje, elecciones internas de federaciones, adhesión de federaciones a federaciones internacionales, regulaciones específicas del fútbol, etc.) ante organismos especializados (TAS, CNOSF, etc.) foros no especializados como la CCI y tribunales nacionales.
La lengua materna de Hervé es el francés. También habla y trabaja en inglés y español con fluidez, y tiene un buen conocimiento del portugués. Hervé ha residido varios años en América Latina (Brasil y Panamá), Turquía, Canadá, Suiza y Bélgica.
Hervé es licenciado en derecho francés y tiene un diploma universitario en derecho español e iberoamericano por la Universidad Paris Ouest-Nanterre. Asimismo, cuenta con el máster general del Institut d’Etudes Politiques de París (Sciences Po) con especialización en negocio internacional y un máster en Global Law and Economics por la Universidad Paris 1 Panthéon-Sorbonne en conjunto con Sciences Po.
Hervé enseña arbitraje en la Universidad de Aix-Marseille (DESU Economic Law).
Antes de incorporarse a MCL Arbitration, Hervé era socio del bufete de abogados estadounidense Brown Rudnick LLP.
